To answer the question... Fresno Police say, it's not allowed to operate.
City attorney James Sanchez says there are no legal loopholes that the city is aware of which allow the dispensary to be there.
Either way, the business owners on the southwest corner of Ashlan and Willow want the medical marijuana dispensary gone.
They didn't want to go on camera today out of concern for their safety, and there was no comment from the dispensary.
Lt. David Newton, Fresno Police: "Often times, you'll see dispensaries read or be aware of a court decision and no matter how unrelated that particular decision may be to their situation, they think somehow that is an approval to go ahead and open up the doors."
The dispensary is located in a shopping center that includes a check cashing business, a church, and a dance studio.
You could smell the marijuana from the baby photography studio right next door.
Business owners have been holding meetings to discuss how to deal with their new neighbor, and they have another one coming up.
Fresno police are now moving to enforce the city's ordinance against this pot dispensary's owner.
Lt. Newton: "He has no choice but to simply stop business. He's not allowed to do this, not only in the city of Fresno, but in the county."
Business owners have become more concerned for their safety since the dispensary opened just a couple of weeks ago.
One business already reported a TV being stolen from it's front lobby.
Northstar Property Management runs the property there, but would only say it is not involved in leasing the space, and landlords did not return our calls.
Fresno police are set to file an injunction against this dispensary.
It's already been given a letter from the city attorney to cease and desist.
Officers say they're also in the process of shutting down two other medical marijuana dispensaries that have opened in the last few weeks.
Fresno Police are furthering their crackdown on medical marijuana.
A permanent ordinance banning the outdoor cultivation of it, is on it's way to city council.
