US - Marijuana facility ban to be mulled by council

Milipitas, CA - Milpitas City Council will consider at its May 17 meeting establishing a 45-day moratorium on the establishment and operation of medical marijuana dispensaries, which would become effective immediately with a four-fifths vote.

According to City of Milpitas correspondence, planning staff has received several written and verbal inquiries regarding the land-use application process for medical marijuana dispensaries. The staff report states California and federal law are not in agreement about the issue, and community sentiment regarding such facilities is mixed.

Since the potential impacts are unknown, city staff is recommending the moratorium to further study the issue.

Tuesday's agenda states planning staff is working with the interim city manager's office and the city attorney's office to draft an amendment to permit such facilities in three zoning districts, and to provide similar regulations as adult businesses.

Late last year, City of Fremont passed a two-year extension to a moratorium banning such facilities within its city limits.

Milpitas City Council's meeting will begin at 7 p.m. at 455 E. Calaveras Blvd.
