Washington State officials are arresting and prosecuting bona fide medical
marijuana patients, despite their new medical marijuana law and poll after
poll consistently showing that 70% to 80% support. Instead of listening to
their constituents, Washington officials appear determined to further
criminalize and incarcerate more and more sick, disabled and dying people.
A disturbing example of this criminalization was recently brought to our
attention in the case of "State of Washington vs. Bruce Jay Buckner." Mr.
Buckner suffers from debilitating and chronic Crohn's Disease, a hereditary
ailment that usually requires many surgeries and frequent hospitalization.
Mr. Buckner has presented the state with three medical authorizations when
only one is required by their statute. The state has seized his car, seized
his life's savings, seized his medication and continued with his
prosecution.
Subsequent to his arrest and loss of medication, Mr. Buckner's condition has
deteriorated to the point that he can no longer continue working. He has
required frequent medical consultations and a hospital procedure. He is
broke, sick and being subjected to unbelievable stress.
We have thoroughly reviewed the evidence in this case and find the
prosecution of Mr. Buckner untenable.
The number of plants he was growing were well within the limits set by both
US federal protocols and Canadian federal regulations for medical marijuana
patients. Mr. Buckner's medical condition is well confirmed - he is a
48-year old male who currently weighs only 114 pounds due to his disease. We
believe this case is just another example of government's misuse of power.
We do not condone members of law enforcement rummaging through our medicine
cabinets to determine how much medicine we should be allowed and in what
manner we must use our medicine. This is an issue best left between the
patient and his/her physician. Law enforcement officers are not qualified to
act as doctors in determining our medical needs. Law enforcement officers
are not qualified to act as pharmacists in determining how much we may use
and by what means.
The American Medical Marijuana Association has offered Mr. Buckner our full
organizational, financial and moral support.
