Online headshop legal questions

My buddy has an online hookah shop and was thinking about adding water bongs and pipes to his site but wasnt sure about the legal issues.

He ships out of California. He read on wikipedia that selling the products online and shipping via mail may be illegal.

However, if its clearly stated that they are being sold for tobacco use does that make it legal.?

Is fed ex considered mail?

Is he allowed to sell them to people of any US state and any country?

Is there specific language he needs to put on his site to make it legal?

Is there any legalities that he should be aware of or should he just stick to hookahs?

Any help would be appreciated.

Ya we read about that online. Since that was back in 03', we werent sure if the laws were still as strict these days considering some states made it legal medically. Also, we werent sure if they loosened up if the verbiage on the site specifically stating the products are for tobacco use.

Does anyone know if there was any online sites shut down lately or if it is for sure still illegal right now? He might have to stick to the hookah stuff.

stick with the hookah stuff unless you want to be made an example of and lose everything, including possibly your freedom...
there are still way too many gray areas, unfortunately...
the last 2 glass manufacturers from the US that advertised here got shut down...
we are dying for the ad revenue, but would rather help save your ass, than set you up for failure...
