Medical Marijuana Advocates File Lawsuit Challenging L. A. Dispensary Ordinance

ASA filed a lawsuit against the City of Los Angeles this week, claiming that certain provisions in a recently adopted regulatory ordinance would shut down virtually all dispensaries in the city.

The local medical marijuana law passed by the City Council and signed by Mayor Villaraigosa on February
3rd requires dispensaries to find a new location within 7 days after the ordinance takes effect. In order to comply with the ordinance, dispensaries must be located at least 1,000 feet from schools, parks, libraries, churches and other so-called "sensitive uses," and cannot abut or be across the street from any residence, which excludes almost all commercial areas in the city.

"The dispensary ordinance passed by the Los Angeles City Council might have been reasonable, if not for some onerous provisions," said ASA Chief Counsel Joe Elford, who filed the lawsuit today. "The requirement to find a new location within 7 days is completely unreasonable and undermines the due process of otherwise legal medical marijuana dispensaries."

Do You Agree with US Rep. Jared Polis?

Following recent DEA medical marijuana raids in Colorado, US Representative Jared Polis (CO-2) made a statement online calling on the DEA to "stop their rogue agents from harassing and raiding our medical marijuana dispensaries."

Rep. Polis also sent a formal letter to US Attorney General Eric Holder, asking about a DEA agent's comments that the DEA will "arrest everybody." Rep. Polis asked whether this is in fact U. S. policy.

Please email U. S. Attorney General Eric Holder today. Tell the Attorney General that you agree with Rep. Polis. Tell the Attorney General that you want him to end all DEA medical marijuana raids, once and for all.

March 22, 2010 at 11 am--Virgil Grant Sentencing Hearing

Following a fateful car accident that left one man dead and a CHP officer paralyzed, a 2008 investigation led to one of Virgil Grant's six dispensaries. The dispensary was raided, and Virgil was arrested and held on dozens of federal charges. The sentencing hearing will take place in the Federal Courthouse at
312 N. Spring Street in Los Angeles, CA with Judge Wilson in Courtroom 6, room 217. Grant faces anywhere from 2 to 15 years.
