Calif Measure Shows State's Conflicted Link To Pot

California has a long history of defying conventional wisdom on the issue of marijuana, including its embrace of the drug in the 1960s and its landmark medical pot law 14 years ago. So it may not be all that surprising that a November ballot measure to legalize the drug has created some odd alliances and scenarios.

Pot growers have opposed it. Some police have favored it. Polls show the public is deeply divided. Only politicians have lined up as expected: Nearly all major party candidates oppose the measure. And hanging over the whole debate is the fact that marijuana remains illegal under federal law.

As the Nov. 2 election nears, Proposition 19 has become about much more than the pros and cons of the drug itself. The campaigns have framed the vote as a referendum on everything from jobs and taxes to crime and the environment.

The measure gained ground in a Field Poll released Sunday, pulling ahead 49 percent to 42 percent among likely voters. The poll also found that Californians have become steadily more permissive toward the drug since pollsters began quizzing state residents about their attitudes 40 years ago.

Proponents say the measure is a way for the struggling state and its cities to raise badly needed funds. A legal pot industry, they say, would create jobs while undercutting violent criminals who profit off the illegal trade in the drug.

"I think it's a golden opportunity for California voters to strike a real blow against the (Mexican) drug cartels and drug gangs," said Joseph McNamara, who served as San Jose's police chief for about 15 years. "That would be a greater blow than we ever struck during my 35 years in law enforcement."

Supporters, including a group of former and current law enforcement officials, have called attention to the failure of the so-called "War on Drugs" to put a dent in pot production in California, and they say police need to pursue more dangerous crimes.

To pull ahead, opponents will have to convince voters that legalized marijuana will create a greater public safety threat than keeping it illegal.

"If the price drops, more people are going to buy it. Low-income people are going to buy marijuana instead of buying food, which happens with substance abusers," said Pleasant Hill police Chief Pete Dunbar, who also speaks for the California Police Chiefs' Association, one of many law enforcement groups against the measure.

As a result, he said, legalizing marijuana would only encourage the cycle of theft and violence driven by people who need money to buy drugs. They argue that the wording of the proposed law would compromise public safety by gutting restrictions on driving and going to work while high.

The state district attorneys' group has come out publicly against Proposition 19, as have many county governments, the editorial boards of the state's biggest newspapers and Gov. Arnold Schwarzenegger, who said the law would make California a "laughingstock."

Under the proposed law, adults 21 and older could possess up to an ounce of marijuana for personal use and grow gardens up to 25 square feet.

The proposal would allow cities and governments to decide for themselves whether to tax and allow pot sales. Opponents say a vague, disorganized patchwork of regulations would ensue and lead to chaos for police and courts.

There's also the prospect of legal chaos, given the fact that pot will remain illegal under federal law regardless of what happens. Every former Drug Enforcement Administration boss is asking President Barack Obama to sue California if the measure passes on the grounds that federal law trumps state law _ the same argument the administration used in suing Arizona over its immigration law.

Proposition 19 is the brainchild of Richard Lee, an Oakland medical marijuana entrepreneur who spent more than $1 million to get the measure on the ballot. Also the founder of a trade school for aspiring marijuana growers and retailers, Lee has pushed legal marijuana as a boon to the state's economy and an important source of tax revenue to help close the state's massive budget deficit. The Service Employees International Union, the state's biggest union, has endorsed the measure as an economic booster.

But analysts have said the economic consequences of a legalized pot trade are difficult to predict. The state Board of Equalization last year said a marijuana legalization measure proposed in the state legislature could have brought California up to $1.4 billion in tax revenue. On Friday, the agency said Proposition 19, which leaves marijuana taxing decisions to local governments, contained too many unknowns for its analysts to estimate how much the measure might generate.

In July, the nonpartisan RAND Drug Policy Research Center forecast that legalizing marijuana could send prices plunging by as much as 90 percent. Lower prices could mean less tax revenue even as pot consumption rose, the group said.

The potential price drop has brought unexpected opposition, or at least suspicion, from rural pot farmers who fear the loss of their traditional, though legally risky, way of life.

Marijuana has become so crucial to rural economies along the state's North Coast that even some local government officials are working on plans for coping with a pot downturn.

The state's medical marijuana economy is thriving as hundreds of retail dispensaries across California sell pot to hundreds of thousands of qualified patients. And some medical marijuana supporters have said Proposition 19 could undermine the credibility of the drug as a medical treatment.

"I'm just against the whole concept of the recreational use of marijuana," said Dennis Peron, the San Francisco activist who was the driving force behind the 1996 ballot measure that legalized medical marijuana.

I can see one major flaw in Chief Pete Dunbar, reasoning. If a person can grow it themselves legaling and you have no money... reasoning dictates that you can grow it youself for pennies on the dollar. Not use some man made form of drug that cost more does more harm to help deal with this screwed up world that the so call leaders have created...

Who is Arnold to talk about the state becoming a laughingstock?

I don't think the price will go down that much. I have already gotten some awesome deals in Humboldt. The good stuff will be there and eventually a few will try to make a buck off of their 25 sq ft... but the biggest customers will be out of staters. How many people will venture into California now just to legally smoke pot. I believe Millions. All kinds of things can happen to even increase the price. And that 25 square foot thing... I wonder how many will actually follow that law. You already have people exceeding the current limits as they are. I know folks that are growing more than they are supposed to in their indoor garden and in their outdoor garden. These people are making hash and that is against the law in their county, yet they claim all over the place to be 100% in compliance.

I really believe a lot more money will come to California from this passing than conservative estimates state.


As far as poor spending money on pot instead of food? I already know people that trade food stamps for other kinds of drugs. Nothing will change there.

It will be a win win for everyone when this passes. As close as we are to the election and the state of the polls now sort of indicate that it is passing. That will not stop the fed from suing, but will speak from the 8th largest economy on the planet the will of the people.

Too bad (for Peron) that he is not equally against the whole concept of recreational use of tobacco.

I know Dennis and can tell you that the above statement was taken out of context.He is not against recreational use of Marijuana,he is against prop 19 however.I also stand against prop 19 and am a marijuana user. It is very misleading and does little for the cause. Big money is behind prop 19 and it`s bought off many a person, but not Dennis ! If you go to different marijuana sites you will notis which ones stand for and against prop 19(mostly as free speach also comes into play in many of the sites) Can you gess which ones are on the take? Prop 19 is a money grab and a low to the marijuana community! Please use you head and vote NO November 2nd! how would a massive reduction in probable cause leading to busts/arrests be bad?

19 does nothing to limit medical use/grow/biz. if it did limit medical use why would the anti medical use gestapo of Steve Cooley and Bonnie Dumanis want folks to vote NO? (LA and SD district attorneys)
 
IF vote no on prop 19... you are a either a grower or greedy person... No law is perfect. Prop 19 is a vote in the right direction. If this ballot goes down in flames it may be years until we get this chance again. Don't be stupid and vote against it because it is not exactly want you want... Start small ! so the world cannot say, see they could'it pass it because it is bad and should be illegal... california voted against it. We need the sanity in cal. to show how much money can be saved and genarated because of marijuana... :thumb:
 
If prop 19 passes it would not be able to be amended until 2012 at the earlyest. Being voted in by the people it would not be able to be tweeked by our representitives.It was desighed for one reason ,for it`s backers to make money! They have bought up and paid for avertisments with money made off sick medical users and are attempting to increase sales to non medical user now.They would have at least two full years of income to advertise and twist peoples minds before a new law could be preposed.

Prop 19 is misleading at best.No person can go to jail for under an OZ in Cali and the fine(now only a ticket and no longer criminal) is only $100 max.Taxes on marijuana can not be determend under prop 19 because it is mostly left to local goverments to impose.There is no max amount they can charge! But when is the last time you paid taxes and felt you got your money`s worth from Big Brother? If prop 19 doesn`t pass you may have to pay a small fine if you are unlucky but it still wouldn`t be as much as the for sure taxes you would be paying under prop 19!

If Prop 19 passes the same people who only worry about their bottem line and add 600 additives to cigarettes will soon be producing your doobies for you.Many small family farmers will be out of work and large corperations will soon take charge of production of Cali`s marijuana supplies.Goverment both state and local will force small growers out on there asses! Now you trust large corp and goverment to keep those prices lower for you? Why should they as you will have little choise but buy from them! Oh you say you can grow your own? Maybe but it isn`t as easy as you might think to grow the dank! You will be limited in space and where you going to get clones from then? You will have to fallow all local laws on growing and have a place to grow enough to get you by until the next crop.Most people have little room as it is and if you rent you will need permission from your landlord.Most people will not be able to grow there own!

Reality is it does change your mental state and should at least be treated as such and kept away from children.......even thought cigs are far far more toxic and they are on peoples tables in easy reach all the time???? Go figure??? I would love to fill my 30 acres with cannabis TRUST ME! despite the 100$ fine, it will remain illegal for every recreational user in this state to grow even one plant, unless 19 passes...get of your asses and legalize grass(es).
