City Attorney snubs San Jose Cannabis Collectives Coalition MC3

In a letter sent to San Jose's City Council members Monday the Medicinal Cannabis Collectives Coalition (MC3) has outlined the numerous flaws in the proposed ordinance to regulate medical cannabis collectives. As written, the ordinance violates State law and common sense and is destined to draw a slew of lawsuits from the collectives, costing the city thousands of dollars and a huge amount of administrative staff time.

The Coalition has maintained a productive, ongoing dialog with the City Manager's staff, Planning staff and Revenue staff, even though they are not in agreement on all issues. By contrast, the City Attorney's office has refused to meet or talk with representatives of the Coalition throughout the process. The Coalition's goal is to save the city time and money by not repeating the mistakes that have been made by other California cities.

Respected, experienced San Jose attorney, Jim Roberts, who represents a number of the collectives said this on behalf of his clients, "We will litigate to defend our rights. We believe we will prevail in Superior Court, and if not in Superior Court, we will prevail on Appeal and will continue operating under court order pending Appeal."

The ordinance that the City Attorney's office plans to present to City Council on June 22nd has 7 major flaws. Some of these are no cash sales, limits on patients choice in where they purchase their medicine, restriction to serve only San Jose residents, locations limited to commercial areas–no industrial zones-- yet requirements to cultivate all medicine on site, and a random lottery to award permits. These are measures that have proved unworkable in other jurisdictions, so it makes no sense to repeat those errors and cause a drain on the city's limited finances.
