City Sues Medical Marijuana Group

A California community is suing a medical marijuana collective for opening in defiance of a city ban on pot dispensaries, officials said.

Buddy's Cannabis Patient Collective opened April 10 in Mountain View, Calif., the San Jose Mercury News reported Thursday.

The Mountain View City Council voted in February to ban such dispensaries, saying it would eventually allow such medical marijuana clubs but needed time to consider regulations, the newspaper said.

Attorney Matt Lucero and a nephew opened Buddy's despite the prohibition, claiming Mountain View's ordinance is illegal.

Lucero said he was not willing to wait while the city developed its regulations.

"There's not one city in this county that has a lawful ordinance allowing for medical marijuana collectives and cooperatives to operate," Lucero said. "I'm not willing to wait any longer."

Mountain View officials told Lucero they intend to sue and seek a preliminary court injunction, the News reported.
