Des Plaines Proposing $15K Fee To Cover Cannabis Policing Costs

Those wanting to open up a medical marijuana shop in Des Plaines could face an additional $15,000 fee.

Des Plaines aldermen will consider the annual fee during their meeting Monday night, Dec. 1. The $15,000 would be designed to offset the potential police enforcement costs due to increased monitoring, patrol, enforcement of the unlawful use of medical cannabis, unlawful operation of vehicles under the influence of cannabis, and other state law violations, according to city documents.

Ald. Mike Charewicz (8th) proposed the idea earlier this month as the city council considered approval of a marijuana dispensary at 415 W. Touhy Ave. Other towns have implemented similar fees in anticipation of marijuana dispensaries. Schaumburg, for example, will consider a $100,000 impact fee at a December village board meeting.

The fee may be necessary to fund the policing of such facilities. Existing sales tax laws do not apply to medical cannabis because it has been classified by state statue as a prescription and nonprescription medicine and drug, according to city documents. As a result, the city is allowed to impose new taxes on the sale of medical cannabis based on measures other than gross receipts or sales prices as long as those new taxes are passed along to the purchaser.

The police department estimated the annual cost of enforcement at $15,000 per medical marijuana business.

In addition to the fee, aldermen are expected to consider approval of the proposed dispensary Monday. If approved, it must still be granted a license from the state of Illinois. State law limits the number of distribution centers to one for each group of townships. The 415 W. Touhy location is within the group that includes Elk Grove and Schaumburg townships, where several other dispensaries have already been approved by their respective municipalities. Each will be competing for the single state license in the area.
