Ill Woman To Appeal Marijuana Conviction

An ailing West Virginia woman was sentenced yesterday to 3 to 5 years in state prison by a Cumberland County judge for transporting 33 pounds of marijuana in her Jeep.

The question is whether Sharon Glaser, 52, who has multiple sclerosis, will serve a day of that sentence.
Her lawyer, Karl Rominger, is seeking a new trial, claiming a new medical evaluation shows Glaser isn't mentally competent to be prosecuted. If he prevails, Rominger said, the court could postpone Glaser's sentence indefinitely.

Judge Edward E. Guido allowed Glaser to remain free on $50,000 bail.
Senior Assistant District Attorney Matthew Smith said his office will fight the appeal.

"We don't believe that the doctor's report on [Glaser's] competency entitles her to the relief that Mr. Rominger seeks," he said.

State police said they discovered the marijuana when they stopped Glaser for erratic driving on Interstate 81 in Southampton Twp. in April 2004.
Glaser, of Great Cacapon, proceeded with a nonjury trial before Guido, knowing she would be convicted and would appeal.

Rominger said he had to allow his client to be convicted to challenge what he claimed was an illegal search of her Jeep. Her mental competency was not raised initially.

Rominger has claimed Glaser needed the marijuana for medicinal purposes because prescription medicines aren't effective in treating her ailment and are too expensive.

Guido told her he had to impose the state prison term because the amount of marijuana was so large.
