CALGARY - Marijuana activist Grant Krieger has gone to jail rather than
pay a fine, but he wasn't allowed to take his pot with him.

Krieger, 46, suffers from multiple sclerosis and says marijuana helps
ease the painful effects of the disease. Last month, a judge granted
him the right to cultivate and use marijuana for medical reasons.

But when he showed up at the downtown Calgary police station Monday to
begin serving a 30-day sentence for violating an earlier probation
order, officers would not allow him to take his pot inside.

Krieger's lawyer, Adriano Iovenelli, calls it a double standard.

"He has an exemption recognized by the courts," he says. "Yet, they
will not allow him to possess it or smoke it while at the Remand
Centre."

Iovenelli says the last time Krieger went to jail, he became very weak
and had to use a wheelchair.

"There are people who serving penitentiary terms who have medicine that
are prescriptions and they are allowed to ingest it at penitentiary's
and other places they are incarcerated," he says. "The question is,
'why shouldn't Grant be allowed to ingest marijuana while he's
incarcerated?'"

Iovenelli says the Remand Centre is holding the bag of pot among
Krieger's personal effects and will give it back when he gets out.
