Medical Marijuana Dispensary Application Denied In Milford

Massachusetts - The Zoning Board of Appeals denied a special permit for the second medical marijuana dispensary seeking to locate in Milford on Thursday after board members raised concerns over the business locating on the second floor of a building. Baystate Alternative Health Care, Inc., a Needham-based non-profit, lost its bid to open a dispensary and grow operation at 425 Fortune Blvd. in a unanimous vote. The dispensary sought to locate on the vacant second floor of the industrial building on Fortune Boulevard and has only internal alterations planned.

Members raised concerns over the safety of locating this type of a business in a building with other tenants. "It seems to me this type of business should be self-contained, not in a building where other people are entering the building," said board member John Dagnese. Owners Robert Carp and Stephen Cottens said they plan to contract a security firm at a cost of $35,000 that includes a security officer on site at all times, key cards and thumbprints required for access and security cameras on the elevator leading to the second floor.

"Nothing is 100 percent secure, but you can take steps to make sure it's as secure as possible and we think we've taken the steps to do that," Cottens said. Cottens said their security plan is above and beyond what is required by the Department of Public Health. Board members also expressed concerns over the safety of other businesses in the building, which include a computer repair business and the Workforce Central Career Center.

"I've got real concerns with the security because the potential is there that other businesses could be adversely effected," said board member Mary Carlson. This application follows that of Bay State Relief, seeking to open cultivation and dispensary operations at 13 Commercial Way. The ZBA approved Bay State Relief's special permit last month and a variance for their business to locate within 200 feet of a residential property. The applicants in Milford are two of 158 that have made it to the second round of the application process with the state Department of Public Health. Ultimately, the state will award 35 licenses across the state, with no more than five per county.
