Medical Marijuana User Charged with Pot Possession

Criminal charges have been filed against Garry Silva of Sky Valley, a medical marijuana user, in relation to a raid on his home by federal agents last March.

A warrant was issued last Friday, and Silva turned himself in at the Palm Springs Police Department Tuesday.

He was released on $25,000 bail, he said in a phone interview today. His case is scheduled for Nov. 22 at the Larson Justice Center of the Riverside County Superior Court in Indio.

Felony charges against Silva include cultivating and possessing marijuana with intent to sell, as well as possession of firearms and live ammunition as a past felon.

Silva said that the firearms charges date back to 1981 and have since been expunged from his record.

At the time of raid, Silva was growing marijuana for a patients' collective, which he said is legal under California's medical marijuana laws.

Riverside County District Attorney Grover Trask last month issued a legal opinion stating federal drug laws take precedence over state laws.
