Dickinson - A sheriff's detective suspended from duty after being accused of growing marijuana continues to receive his 52-thousand-dollar salary.
Thirty-five-year-old Christopher Smith is also fighting Broome County to get back the one month's pay he was docked after his arrest in July.

Under the state's civil service laws, Broome County Sheriff David Harder could only remove Smith from the county payroll for 30 days. After that, Smith continues to receive full pay, pending the outcome of his criminal case.

State police were investigating a domestic incident at Smith's home in July when they found several marijuana plants on the property. Smith pleaded innocent to a misdemeanor charge of growing pot. He remains free, drawing a paycheck, while the case is investigated.
