Nipomo Medical Marijuana Dispensary Denied

A medical marijuana dispensary proposed for Nipomo was denied today on a 3-2 vote by the San Luis Obispo County Planning Commission.

Commissioners Anne Wyatt and Carlyn Christianson voted to approve the minor use permit for the dispensary proposed for Lindon Lane by Robert Brody of Los Angeles and Tom Meredith of Long Beach.

Brody and Meredith have 14 days to appeal the denial to the Board of Supervisors, but Brody - who expressed disappointment with the decision - said they have not yet decided whether to appeal.

Under county ordinances, medical marijuana dispensaries must be more than 1,000 feet from a school, park, recreation or youth center.

County planning staff had recommended the commission deny the minor use permit because the facility would be within 94 feet of a private gymnastics studio, although it would be more than 1,000 feet from Nipomo High School.

Commissioners had to decide if the private facility fell within the county's parameters for a public youth-serving facility. Wyatt and Christianson believed it did not.

The facility met overwhelming public opposition during a South County Advisory Council committee meeting in January.

The full council, which advises the County Board of Supervisors on land use issues, subsequently voted to recommend denial of the dispensary.
