OH: Council Bans Medical Marijuana For 2 Years

Findlay City Council's final vote on a moratorium affecting medical marijuana was without fanfare Tuesday.

Council's attention and ire shifted to a projected budget shortfall, and questions about whether the city's policy of allowing certain businesses to delay paying estimated taxes is driving the red ink.

Council voted 9-1 to enact a ban on dispensing, cultivating or processing medical marijuana within city limits until Sept. 8, 2018. That will be exactly two years from the date the state Legislature legalized the drug, without putting any rules in place to govern it.

Seventh Ward Councilman Tim Watson voted against the moratorium. Watson has been outspoken in his opposition to making the drug inaccessible to sick people with a prescription to use it.

Grant Russel, councilman-at-large, made a motion to amend the legislation and set the two-year time limit.

He said the limit will give the city an opportunity to "send the issue through the zoning process."
Council also voted 9-1, with Watson opposed, to enact zoning rules to reinforce the ban.

The ban makes it a first-degree misdemeanor to dispense, cultivate or process medical marijuana in the city, punishable by up to six months in jail and a $1,000 fine. Violating the city's zoning law could also carry daily fines.

City Council could revisit the issue sooner, if state officials establish rules inside of two years.
