The Iowa Supreme Court has overturned a man's drug conviction saying police needed a separate warrant to search the room he was renting in a home where drugs were found.
The court ruled Friday that police violated Joshua Fleming's
constitutional rights to privacy when they searched a room he was renting in a home in Sioux City.
The court says a small baggy of marijuana found in Fleming's room cannot be used as evidence.
Police obtained a warrant to search the house and found larger
amounts of marijuana and $14,000 in cash in other areas of the home.
The court says someone renting a room in a house has an
expectation of privacy and police should have obtained a separate warrant to search the room.
Fleming's attorney, Mark Smith, says the ruling supports what
the law is regarding illegal searches. Smith says without evidence it is unlikely the case against Fleming will go forward.
