Two Medical Marijuana Dispensaries Granted Exceptions in SMC

After enacting an emergency temporary moratorium in late April on businesses selling or distributing medical marijuana to the public in the unincorporated areas of San Miguel County, the Board of County Commissioners granted two businesses exceptions to it in a 3-0 vote last week.

The moratorium was designed to give the county, which does not yet have any land use or other regulations specific to medical marijuana dispensaries in place, time to determine the effect of a state law concerning sales and distribution of the substance that was pending at the time. It does not apply to those who may be growing or cultivating medical marijuana provided they are not operating a dispensary or are otherwise selling the product.

Gov. Bill Ritter signed two bills into law on June 7 that increase oversight of medical marijuana in Colorado by strengthening the rules for dispensaries and physicians.

"[The exceptions] are something I can recommend approval of as consistent with the Land Use Code," County Planning Director Mike Rozycki told the commissioners.

They authorize the county planning department to approve development permit applications received from C&C, LLC on Front Street in Placerville, and on behalf of Delilah, LLC in the Illium Valley Industrial Park.

By granting the development permits the BOCC is essentially giving the business owners an opportunity to apply to the state for an interim license to sell or distribute medical marijuana from August 1, 2010 to July 31, 2011 in accordance with the new state laws.

Although the county notified property owners located within 500 feet of the establishments that it was considering granting exceptions to the temporary moratorium, it received no responses or objections to either.

The few calls Rozycki did receive, "Were more as to 'How do we get in the business?' than concerns," he said.
