Yreka Moves Toward Medical Marijuana Dispensary ban

Yreka, Calif. – At its Thursday meeting, the Yreka City Council took another step toward banning medical marijuana dispensaries from opening shop within the city limits.

The council voted to waive the first reading of Ordinance 817, which modifies the Yreka Municipal Code to prohibit medical marijuana distribution facilities.
There were no public comments during the public hearing. The council will vote on the adoption of the ordinance at its next regular meeting on Oct. 6.

"The purpose of this ordinance is not to intrude on the rights of medical marijuana recipients that exist under the Compassionate Use Act (Proposition 215). It is directed toward distribution activities," Yreka City Attorney Mary Frances McHugh said.

McHugh also referenced Assembly Bill 1300, which Gov. Jerry Brown signed into law on Sept. 1. The law gives local governments the green light to regulate or ban marijuana dispensaries within their borders.

There is currently a moratorium on the issuance of business licenses for Yreka medical marijuana distribution facilities that will lapse on Oct. 19.
