CA: Rio Dell City Council To Discuss Possible Cannabis Tax

The Rio Dell City Council on Tuesday evening will discuss options for placing a cannabis tax measure on the ballot.

The council will also receive the mid-year financial report and a public works update before setting priorities and hearing an update on the city hall ADA porch project, according to the meeting agenda.

The possibility of a cannabis tax was discussed at length last year but the council wasn't able to finalize the measure before the deadline to place a tax measure on the November ballot. According to a staff report, city staff will recommend the council prepare for putting the tax on the November 7 ballot or a vote-by-mail special tax measure for an August 29 election.

"Rio Dell currently derives no direct revenue from the cultivation, processing or sale of marijuana, for medical purposes or otherwise. However, the city still bears the costs associated with enforcement of state law related to cannabis, whether it is under the framework of Proposition 64, the medical marijuana framework, or illegal/unregulated activity," the staff report states.

The city passed commercial medical marijuana land use regulations that restricts marijuana businesses to the saw mill site north of the city and across the Eel River. Development of businesses on the site are in the preliminary stages but once they're up and running the city wouldn't get tax revenue without a voter-approved tax measure.

On the recent November ballot was Measure T which asked voters about allowing the commercial medical marijuana businesses in the saw mill area if the activity is subject to local taxation.

"Measure T passed by 53.41% to 46.59%," the staff report states.

At a special meeting earlier this month, the council listed staff retention, labor negotiations, improved code enforcement, budget review, saw mill development, submitting a cannabis tax measure to voters, transparency review, stable funding for streets and many other priorities.

At the same meeting, the council will also receive a presentation on the plans to replace the current city hall and police station front stairs and porch with ones that are ADA compliant and accessible.
