<img src="https://www.420magazine.com/gallery/data/1073/user0055.gif" align=left>On July 21, 2008, at approximately 7 P.M., the Yavapai County Sheriffs Office was notified by a motorist reporting the driver and passenger in a blue Toyota Scion were passing and smoking from a marijuana pipe. The Scion was currently traveling south on highway 69 near the highway 169 intersection. A YCSO deputy eventually located the vehicle as a result of ongoing communication between the informant and YCSO dispatch, resulting in a traffic stop on highway 69 near milepost 275.

As the deputy spoke with the driver, he detected the strong odor of marijuana from the interior of the vehicle. The driver was identified as 24-year-old Prescott resident, Gustavo Dejesus Jr., and the passenger, also from Prescott, was identified as 20-year-old Brian Shermeta. Both occupants were nervous and displayed symptoms of marijuana intoxication.

Deputies located the marijuana pipe on the passenger floorboard and a further search of the vehicle revealed a cigarette pack in the center console containing a baggy of marijuana. A bottle of Clear Eyes eye lubricant was also found in the center console and is commonly used to mask the effect of marijuana intoxication in the eyes.

The deputy also determined that Dejesus was driving under the influence of marijuana after a series of test completed by a D.R.E (Drug Recognition Expert) qualified YCSO deputy. As a result, Dejesus was additionally charged with Driving Under the Influence of a Drug.
