The American Civil Liberties Union says it has helped reach a settlement in a wrongful death lawsuit it filed on behalf of the mother of a quadriplegic man who died while custody of the D.C. jail.

The ACLU says 27-year-old Jonathan Magbie died in 2004 after jail officials and Greater Southeast Community Hospital didn't provide adequate medical attention while he served a 10-day sentence for marijuana possession.

ACLU officials say Magbie, who needed a ventilator to breathe, developed pneumonia while incarcerated. He died after being transferred to the hospital.

Among agreements of the settlement, the ACLU says D.C. correctional officials will modify some policies to protect prisoners with medical problems and physical disabilities. Officials say Magbie's mother, Mary Scott, will also receive an undisclosed amount of money as part of the settlement.

Dear John Walter's...

Mr. Magbie is yet another Unicorn.

As per the wise Mr. Rhorbacher's comments at NORMLcon, Mr. Magbie is the Patient Saint of Unicorns.

He died a skant 5 miles from your DEA office from choking on his own mucas, in his jail cell, after being denied his respiratory inhaler.

His crime you ask?

Possession of a single joint, and a little attitude in court. He only made it 4 of the 10 days of his jail sentence, and died in suffering the same day the beauracracy finally agreed to allow his medical device to come into the prison.

The truth is there are no known deaths from Marijuana, but there are plenty from prohibition.

So Mr. Walters, not only are there unicorns, but you and your ilk are killing them in your own back yard.

It won't be long until you are no longer in public office; please don't let the door hit you in the ass on your way out.

disrespectfully,
soniq420

PS - for those that aren't familiar with the reference, Walter's was caught on tape saying that finding a person in jail for non violent possession of marijuana was as rare as finding a unicorn.

Approximately 90% of the roughly 880,000 marijuana arrests in 2007 were for non violent possession according the FBI's Unicorn (Uniform) crime report.
