Marijuana Dispensaries Face Permanent Ban

Medical marijuana dispensaries may not ever be allowed in Mission Viejo.

That will be decided at Monday's City Council meeting when the council will vote on an urgency ordinance prohibiting all land uses that contravene state or federal law. If approved, it will go into effect immediately.

A similar ordinance will be introduced that will add a section to the municipal code prohibiting all land uses that contravene state or federal law. If approved, this ordinance will be effective 30 days after its second reading.

Established by the council on May 15, 2005, the moratorium came amid controversy over the regulation of medical marijuana. California voters decided to let doctors prescribe medical marijuana by passing Prop. 215 in 1996. However, the U.S. Supreme Court ruled on June 6, 2005 that federal authorities could prosecute people who cultivated or possessed the substance, regardless of doctor's approval.

The meeting will begin at 6 p.m. at the City Hall, 200 Civic Center.
