Medical Marijuana Hearing Set At City Hall

The Laurel City County Planning Board will conduct a public hearing tomorrow night, June 3, to discuss proposed additions to the list of uses to develop land use regulations for medical marijuana businesses.

The hearing will be at the beginning of the regular Laurel City County Planning Board meeting which begins at 7 pm., in City Council Chambers at Laurel City Hall.

The purpose of the public hearing is to present information about proposed changes to zoning regulations and to hear public input concerning where the businesses should be located.

When its review is completed, the board will make recommendations to the City Council for changes to the City Zoning regulations concerning the location of medical marijuana retail businesses and grow operations.

At the last planning board meeting, the board reviewed a Yellowstone County GIS map of the City as they considered making zoning recommendations to the Laurel City Council concerning locations for medical marijuana businesses.

The map showed the locations of Laurel schools, churches and parks and placed a 1,000 foot buffer zone around those locations. The city attorney suggested the board also may want to establish buffers around day care centers.

City Planner James Caniglia pointed out the areas where retail sales of marijuana could be located and the locations where marijuana grow operations could be located.

He told the board that because of the historic hazard of fire from marijuana grow lamps and mold that goes along with marijuana growing, it should only be allowed to be grown in the industrial areas of town.

The board is considering establishing 1,000 foot buffers between each medical marijuana retail location. The same regulation is being considered for marijuana grow locations.

Caniglia discussed the issue of marijuana business locations with Laurel Police and the Yellowstone County Sheriff's Department and they concurred that the preferable area to locate the placement of growing operations would be in light and heavy industrial zoned areas, while retail sales could be done in areas with commercial zoning.

The city is currently under a temporary six-month moratorium on establishing medical marijuana businesses in the city limits. The moratorium that became effective on adoption was approved by the Laurel City Council at its March 16 meeting. That moratorium may be extended when it expires.
