Ohio might be the next state to legalize marijuana, if a proposed amendment receives enough signatures and is approved by voters.

But those who are looking to light up as soon as the law goes into effect may want to hold off.

According to an analysis of ResponsibleOhio's proposed constitutional amendment to legalize marijuana in Ohio, employers' drug policies would still have control over whether or not employees could smoke marijuana.

So if your company has an anti-drug policy, a potential law legalizing marijuana would have little to no impact.

"We wanted to be sure we were being consistent with reality when we said we would not force employers to change their policies," said Lydia Bolander, a spokeswoman for ResponsibleOhio.

The research looked at the language within the amendment as well as existing case law, said Jonathan Secrest, the lawyer who conducted the analysis.

"It is our opinion that the legal precedent is on the side of the employer," Secrest said in an email. "ResponsibleOhio's proposal will not compel an employer to loosen their standards on drug testing or consumption in the workplace."

Marijuana remains an illegal drug under federal law. That has led multiple courts to dismiss employee claims of discrimination and wrongful termination, the analysis found.


ResponsibleOhio has passed the first couple of stages of getting the marijuana issue on the November ballot for the general election. The pro-marijuana legalization group now must collect more the 305,591 signatures by July.

The group said they have collected well over 250,000 signatures, and expects to break 300,000 within a couple of weeks.

ResponsibleOhio has also come under fire from other pro-marijuana groups because many claim their proposal supports the monopolization of the marijuana industry.

Of course they want to make money... but why would you want to stop progress? 4 plants per person for private grows...the ability to be a dispensary owner/security/accessories etc... the only ones that seem to be pissed are those who think they would "be able to grow and sell" knowing that all "product" coming from only 10 grow sites...knowing that it is legit, clean, and exactly what they say it is....vs bug infested, crap from sketchy growers....yeah I'm all for it, and again it's only a 3 yr plan which means the market will be open in a short amount of time...I personally don't want to wait 3 more years for a freedom everyone should have right now.

and you have to " register" your grow so the state can come anytime day or night to inspect. DO NOT SUPPORT RESPONSIBLE OHIO. They are a fraud. These are all far right wing republicans who are not interested in people at all. just their greedy selves.
 
where do you see you will be a dispensary owner? Read about all the fun dispensary owners are having in Colorado paying out all their money in unfair taxes. The Responsible Ohio people will be the dispensary owners too. When prohibition ended did the state give Pabst the exclusive right to sell Pabst beer at Heineken prices? Come on, there are better ways to do this and much better ideas than the mafia Responsible ohio chumps.
 
What are your thoughts on "better for Ohio" lmahio. I just found it today and it immediately sounds better. No hard feelings chief..if it's between these 2 then I'm voting for it...yes I am from Ohio. If it's norml or nothing then nmrl wins. So hopefully it's a legitimate competition.

The "The End Ohio Cannabis Prohibition Act" does look a lot better. It looks and reads legit. see below:

Section 7. Limitations

(A) There may be no limits or restrictions placed on the potency of cannabis products for personal use by any governing body in the State. A rating system of potency may be established, if necessary, but may only be used as a source of reference and for advertising.

(B) The commercial production of cannabis shall have no limits on the number of cannabis plants to be cultivated or the amount of cannabis products that may be possessed under the commercial license at any given time.

(C) The non-commercial production of cannabis shall be limited to cultivation of no more than twenty four (24) cannabis plants per person, for up to four (4) persons per household. If any of the four (4) persons do not live on the premises, yet are having their cannabis grown there, then they may not grow cannabis non-commercially at any other locations.

(D) The non-commercial production of cannabis shall not include any limits on the amount of cannabis products that may be possessed, whether on site or not, so as to allow persons to transport cannabis products freely and safely to customers and retailers.

the ResponsibleOhio bill ... It sounds like bullshit. Licensed and regulated even for the home grower. see below

(D) Personal Use of Marijuana and Authorization of Homegrown Marijuana

It is lawful for persons 21 years of age or older to purchase, possess, transport, use and share with another person 21 years of age or older one ounce or less of marijuana or its equivalent in marijuana-infused products.

It is lawful for persons 21 years of age or older to grow, cultivate, use, possess and share with another person 21 years of age or older homegrown marijuana in an amount not to exceed four flowering marijuana plants and eight ounces of usable homegrown marijuana at a given time; provided, however, that such person must first obtain a non-transferrable license pursuant to Commission-promulgated rules and regulations, which include, at a minimum, registration requirements and rules ensuring that homegrown marijuana is not grown or consumed within public view and that home-growing takes place in an enclosed, locked space inaccessible to persons under the age of 21.

Thoughts? They make a very good case on why "RO" will pass unless a "better" plan is available.

This initiative is designed to eliminate the Responsible Ohio (RO) initiative and at the same time create an initiative that is better for Ohio.

We achieved this by first looking at the weaknesses of the RO initiative then using their initiative as the foundation, modify the areas of weaknesses so that they were better and we did the changes in a way that in each case, would make it preferable to the voters. Since 10%-15% of voters have a real problem with the predetermined cartel of 10, we expanded it to 40 and the additional individuals/groups can be any individual or group of Ohioans that are interested. We are inviting these people to contact us about acquiring one of the grows as we are collecting signatures. If your interested send us an email to find out more. If you know of someone or a group that might be interested, let them know the notes required to get a license to grow are available (until they are gone).

Legalizes homegrown marijuana up to 8 plants of which only 4 can be flowering and up to 8 ounces of usable homegrown marijuana. Must be in an enclosed, locked space.

Sounds somewhat better but do they have the money to push their agenda?

The RO people are in charge of this other ballot initiative also I think. Their sites are still front and center with too many restrictions and huge buy ins. This is just a bigger cartel, or one trying to look more user friendly but in fact has the same money behind it.
 
Read Illinois v Krull 107 S. Ct. 1160. Licensing now would mean warrantless searches without any probable cause necessary to make sure that you re "complying" with the licensing scheme. The better for Ohio scheme is just a guy trying to hijack the responsible Ohio pirates, one pirate preying on another group of pirates, hoping to get himself a big chunk of hush money from RO. Both these " proposals" stink to high heaven. You will NOT be better off under either one!

Licensing means warrantless searches by regulatory bodies. And this other proposal and the 120,000$ " license place set " makes you think that they think they are going to be in control of any regulatory agenciy, doesn't it? Obviously a scam.
 
Ed Howard tells me that the 120,000 " fee" is but a "prerequisite" to a license. If you have been foolish enough to give Ed Howard anything, I would recommend getting it back ( which will prove impossible) or contact the Ohio Attorney General Mike Dewine.
 
COLUMBUS, Ohio -- One of three proposed marijuana legalization ballot proposals in Ohio failed to clear an initial state hurdle on Thursday.

Attorney General Mike DeWine announced that he has rejected a petition for the proposed Cannabis Control Amendment on the grounds that the summary of the petition was not "fair and truthful."

Ohioans to End Prohibition, the Cleveland-based group pushing the proposed amendment, plans to revise and resubmit their summary language to DeWine, said Jacob Wagner, the group's vice president.

The proposed amendment would legalize recreational and medicinal marijuana use throughout Ohio.

Unlike other pot legalization initiatives pushed by the groups ResponsibleOhio and Better For Ohio, the Cannabis Control Amendment would not limit marijuana production to a certain number of chosen locations.
