DETROIT, June 30 (UPI) -- A Michigan man who legally uses medical marijuana is suing Walmart for firing him after he tested positive in a drug test
, records show.

Joseph Casias, 30, who has an inoperable brain tumor and is in remission for sinus cancer, says he uses marijuana at night to alleviate pain, the Detroit Free Press reported Wednesday.

The lawsuit was filed by the American Civil Liberties Union in Calhoun County Circuit Court Tuesday, the newspaper said.

"It's very unfair that I was fired," Casias said. "I hope that this doesn't happen to other medical marijuana patients across the state."

In 2008 Michigan voters approved medical marijuana use in a measure that "protects employees from being disciplined for their use of medical marijuana."

Though Casias showed a store manager his medical marijuana card issued by the Michigan Department of Community Health, he was ultimately fired for testing positive for the drug, the lawsuit says.
