Fight to Keep Medical Marijuana Dispensaries

One open sign remains on at a local medical marijuana dispensary, but there may be more lighting up their neon signs.

"We're going to file a stay of the lower court proceedings and a stay of the court of appeals," defense attorney, Matt Newburg, said.

That stay will hope to do just one thing.

"What we're trying to do, essentially is ask the Michigan Supreme Court to rule in a manor that was similar to that of the circuit court," Newburg said.

If the Supreme Court rules similar to the circuit court, pot shops in the area will be able to turn their signs back on. But, regardless of that ruling, Hydroworld's owner said in an interview last week they will remain open.

"We're going to stay open because our patients want us to," Danny Trevino, said. "They keep asking us to fight it, we don't know how else to fight it because it seems like the people who are supposed to fight for us are fighting against us."

That fight may get tougher. Police have said they will be checking pot shops in the area to see if any have stayed open after the cease and desist letters were issued last week.

Hydroworld is willing to fight this, but defense attorney Matt Newburg has just one piece of advice.

"It has been my advice to everybody to close. I can't get any clearer than that."

Newburg's instructions are clear, but for the time being, Hydroworld's sign says open.
