Man Gets Deferred Sentence For Stevensville Marijuana Shop Break-In, Beating

HAMILTON - A man convicted of breaking into a medical marijuana shop and taking part in a vigilante-style beating of his accomplice will stay out of jail if he steers clear of trouble for the next four years.

Jesse Shoup, 26, of Victor was sentenced Wednesday for felony intimidation and burglary.

Ravalli County District Judge Jeffrey Langton followed the recommendations of a plea agreement that deferred imposing the sentence on the man for four years.

The agreement included more than 20 conditions Shoup will be required to follow while on probation. If Shoup stays out of trouble, the felony charges will be dropped from his record at the end of four years.

As part of the plea agreement, Shoup agreed to testify in any trial of the other three men involved in the beating of 22-year-old Beau Miller last May.

The vigilante-style beating followed a break-in and theft at the now defunct John Stone Foundation medical marijuana dispensary at the Wye in Stevensville last May.

Court records said Shoup lured Miller to the scene of the beating after being confronted by the dispensary's owner, Tracy Moser, over his own involvement in the burglary of the business.

Shoup drove Miller to a remote spot on South Burnt Fork Road, where Moser and two other men waited with clubs.

Miller pulled a pistol when confronted by the men.

At Wednesday's hearing, Shoup's attorney, Carol Johns, said Shoup grabbed the pistol and pointed it downward during the struggle.

"He actually took an active part in protecting the other persons involved," Johns said.

Miller eventually escaped the beating and sought refuge at a nearby home. One of the two lacerations on his head took 15 staples to close.

Miller was handed a three-year deferred sentence earlier this year on a felony drug charge in connection with the Stevensville case.

At Wednesday's hearing, Johns said Shoup wanted the record to show that Miller assisted him in burglarizing the marijuana shop.

"That was a joint effort," she said.

Shoup is a disabled Iraq war veteran.

Kory M Gassman, 31, and Jason E. Weis, 35, have pleaded guilty to their roles in the beating. The Hamilton men are awaiting sentencing.

The case against Moser continues.
