Mich. Man Sues After Firing Following Drug Tests

HOWELL, Mich. - A Michigan man who was fired in 2006 after failing drug tests for marijuana as part of his former employer's anti-drug policy is suing the company for emotional distress.

Jeffrey Nikkila of Pinckney claims in the lawsuit against Howell-based Ogihara America Corp. that the auto parts supplier reneged on a promise of job security if he passed an additional drug test.

Nikkila said in a deposition he used marijuana once and tried to use tea to cleanse his system of drug traces.

Ogihara lawyer Linn Hynds said Nikkila was aware of the policy. Hynds called the claim "ridiculous and bizarre," and said the additional drug test eventually came back positive for an illegal drug.

The lawsuit filed in 2007 in Livingston County Circuit Court is set for trial March 17.
