Las Vegas - Even though recreational marijuana will be legal in Nevada on January 1, users could still get in big trouble with their employers for partaking.

While it will be legal for adults 21 and older to possess up to an ounce of marijuana, it will ultimately be up to individual employers whether workers are allowed to use the drug and still keep their jobs. Making matters worse for the would-be user is the fact that pot is still an illegal drug on the federal level.

At ArcPoint Labs in Las Vegas, Jimmy Platt and his team conduct employment drug screenings for more than 600 companies.

"A lot of jobs revolve around whether it's limos whether it's helicopter pilots - all of these people need drug testing," said Platt.

Safety sensitive jobs like operating heaving construction equipment and even casino workers who are regulated by the federal government will still require drug testing.

The marijuana retail industry is still in its infancy as state lawmakers are expected to work out the rules governing the industry in the coming months.

"This is something where we're still going to have very strict rules around marijuana around how it's sold, the potency of it," said marijuana advocate Joe Brezny.

Marijuana is still considered a dangerous and illegal drug by the feds. Currently, there's no way to conduct live sobriety tests like there are for alcohol with breathalyzers.

"Right now we have no metric to judge intoxication of people — there's no .08 — everybody is different," said Platt.

Many companies will likely adopt a blanket ban on the drug, Platt anticipates. A new reality forcing employers to adapt so they can better spot the signs of impairment.

"We'll have to tighten up I believe there will have to be more training in middle management to recognize intoxication in the work place," said Platt.

While it will be legal to possess up to an ounce of marijuana on January 1, it could still be another year before rules are in place allowing recreational sales to the general public.
