Court Upholds Convictions

The Oregon Court of Appeals recently upheld the convictions of two Washington men caught with five pounds of marijuana in their vehicle on Interstate 5 in Roseburg in 2004.

Stanley Ronald Guinto and Ron Ry, both 23 at the time of their arrest, were pulled over June 29, 2004 in Roseburg by Oregon State Police Trooper Kevin Bennett.

The men were ultimately convicted for delivery of a controlled substance. On appeal, they argued Bennett's search of the vehicle was illegal because the trooper failed to obtain voluntary consent.

In general, the men argued Bennett asked for consent multiple times within a short period, leading them to believe they did not have a choice in the matter.

During their trial in Douglas County Circuit Court, the men tried to suppress the evidence the trooper found in the car, but Judge William Lasswell denied the move.

The appeals court upheld the decision Wednesday, finding that the men never refused the trooper's persistent requests to search and eventually gave voluntary consent.
