NY Marijuana law and donations

Stores are giving away free cannabis for donations, or giving away cannabis when you buy a sticker; it's legal. Given this, can those that sell dime bags on the street corner do the same thing?

The whole thing is grey area.... And most lawyers are refusing to follow up or pursue lawsuits as the cost to file the suit out weighs the fine given.

But I do have a few friends who sell on the block and they have said they get left alone ....cops only care about the hard stuff.
